1. Agreement
By creating an account, signing in, accepting an invitation, starting a subscription, or using 37 Training, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
If you use 37 Training for a coaching business, team, gym, clinic, school, or other organization, you represent that you have authority to accept these Terms for that organization and for the users you invite or manage.
2. The service
37 Training provides software for coaches and clients to build programs, assign training, log workouts, upload form review media, exchange messages, manage rosters, review training history, request support, manage subscriptions, and use AI-assisted programming tools.
37 Training is software. It is not a coach, physician, physical therapist, emergency service, medical device, medical record system, or substitute for professional judgment.
3. Accounts and authority
You must provide accurate account information, keep your credentials secure, and tell us promptly if you believe your account has been compromised.
You are responsible for activity under your account. Coaches are responsible for the workspaces, invite codes, client records, programs, messages, notes, uploaded files, and media they create, import, or manage.
Do not invite a client, upload client information, or submit client data to AI-assisted features unless you have the rights, permissions, and consents needed to do so.
4. Coach and client responsibilities
Coaches are responsible for programming decisions, coaching advice, client screening, client consent, and deciding whether a client should train, modify, pause, or seek medical care.
Clients are responsible for using judgment, following professional medical advice, accurately logging training where practical, stopping activity that feels unsafe, and seeking medical help when needed.
Do not use 37 Training for emergencies or urgent health concerns.
5. Health, fitness, and safety
Training can involve risk, including injury. Programs, logs, charts, messages, AI output, coach notes, pain feedback, estimated maxes, adherence signals, form reviews, and other app content may be incomplete, incorrect, delayed, or unsuitable for a particular person.
37 Training does not diagnose, treat, cure, prevent, or monitor any disease or medical condition. Any health, pain, readiness, adherence, or performance information in the service is informational and should not replace professional health care.
6. HIPAA and regulated use
37 Training is not intended to be used as a HIPAA-covered medical record system or as a business associate for HIPAA-regulated workflows unless we have signed a separate written agreement that expressly permits that use.
You may not use 37 Training to provide regulated medical care, collect protected health information for HIPAA-covered workflows, or run a clinical service unless that separate written agreement is in place.
7. User content
Users may submit content including names, contact details, coach profiles, branding, programs, exercises, workout logs, notes, pain feedback, messages, support requests, reports, images, videos, files, and AI prompts.
You keep ownership of content you submit. You grant 37 Training a limited license to host, store, process, transmit, display, copy, format, modify for technical operation, and otherwise use that content as needed to provide, secure, support, maintain, and improve the service.
You represent that you have the rights and permissions needed to submit the content, including any client information, minor-related information, images, videos, health-related details, or third-party material you enter.
8. AI-assisted features
37 Training may use third-party AI providers to draft, edit, validate, summarize, or repair training programs and related content. AI output can be wrong, incomplete, unsafe, biased, or inappropriate for a specific client.
AI output is a draft, not professional advice. Coaches must review and accept responsibility for any AI-assisted program, warning, summary, or recommendation before using it with a client.
Do not submit sensitive client information to AI-assisted features unless it is necessary for the coaching task and you have the right and consent to use it.
9. Messaging, uploads, and moderation
The service includes coach-client direct messages, group or announcement channels, support tickets, attachments, uploaded form videos, reports, and blocking tools.
Do not upload or send unlawful, abusive, harassing, threatening, exploitative, sexual, hateful, infringing, misleading, malware-related, privacy-invasive, or otherwise harmful content.
We may filter, block, remove, review, preserve, or disclose content when needed to operate the service, enforce these Terms, investigate reports, protect users, comply with law, or respond to safety and security issues.
10. Acceptable use
You may not misuse the service, bypass security, probe or attack systems, scrape data, reverse engineer the app except where law allows, interfere with others, impersonate someone, create fraudulent accounts, violate intellectual property rights, violate privacy rights, or use the service for unlawful purposes.
You may not use 37 Training to train competing AI models, build datasets from other users content, sell access to the platform without permission, or use the service in a way that creates legal, security, or safety risk for 37 Training or its users.
11. Subscriptions, billing, and credits
Paid plans may include client limits, billing intervals, trials, renewal terms, subscription status, and AI generation credits. Current plan details are shown in the app or at purchase.
When purchased through Apple, billing, renewal, cancellation, and refund handling are managed by Apple and the App Store subscription terms. RevenueCat may be used to manage subscription status and entitlements.
Deleting your 37 Training account does not automatically cancel an App Store subscription. You must manage cancellation through your Apple account subscription settings unless Apple provides another cancellation method.
AI credits, feature limits, prices, and plan names may change. We may correct billing errors or suspend paid features for non-payment, suspected fraud, chargebacks, subscription expiration, or abuse.
12. Account deletion and termination
You may stop using the service at any time. The app includes an account deletion flow with a recovery period before deletion is finalized. You can also request deletion through the website deletion page or support email.
Account deletion is intended to remove or de-identify the account and associated personal data we are not legally or operationally required to keep. Some records may be retained for legal, security, billing, audit, dispute, abuse-prevention, backup, or operational reasons.
We may suspend or terminate access, remove content, or restrict features for violations of these Terms, security risk, non-payment, legal requirements, suspected abuse, or harm to the service or other users.
13. Intellectual property
37 Training owns the service, software, design, workflows, branding, and related materials. Except for rights expressly granted in these Terms, no rights are transferred to you.
You may not copy, resell, sublicense, or commercially exploit the platform except as allowed by your normal use of the service.
14. Third-party services
The service may depend on third-party providers for hosting, authentication, database storage, file storage, push notifications, email, messaging, support, billing, payments, analytics, security, app distribution, and AI processing.
Third-party services may have their own terms and privacy practices. We are not responsible for third-party services outside our control.
15. Availability and changes
We may change, suspend, or discontinue features, providers, plans, limits, AI models, or availability as the product evolves, as providers change, or as required for security, legal, or operational reasons.
We may update these Terms as the product, providers, pricing, or legal requirements change. Updated terms will be posted with a new effective date. Continued use after an update means you accept the updated Terms.
16. Disclaimers
The service is provided "as is" and "as available." We do not guarantee uninterrupted access, error-free operation, medical or fitness outcomes, business results, data accuracy, AI accuracy, or that every issue will be detected or prevented.
To the fullest extent allowed by law, 37 Training disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of liability
To the fullest extent allowed by law, 37 Training will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; training injuries; or business interruption.
To the fullest extent allowed by law, our total liability for claims relating to the service will not exceed the amount you paid to 37 Training for the service in the three months before the event giving rise to the claim, or 100 dollars if you did not pay us.
